The State Government of Western Australia has recently passed legislation that permits clean fill (and other fill material meeting certain thresholds) to be used on development and construction sites without attracting any waste avoidance and resource recovery fees. In order for a sample to be considered uncontaminated the Department of Water and Environmental Regulation requires both the total concentration and leaching tests to assess the quality of the fill material.
