This ConsumerMail looks at the chemicals that have been added and removed from the Reporting List of CHCC in the US, as well as the CPSC's final rule on Phthalates.

US- Amendment of Reporting List of CHCC

In September 2017, the Washington State Department of Ecology adopted Children’s Safe Product the reporting rules (Chapter 173-334 of the Washington Administrative Code) requires companies to submit annual report of the presence of chemicals of high concern to children (CHCC).

The list expanded with 20 chemicals while 3 have been removed. The rules become effective on 31 October 2017.  This following tables highlight the amendments that have been made.

Also:

  • Set a single annual reporting date consistent with reporting in other states;
  • Made other minor amendments that include:
    • Updated the reporting schedule to remove obsolete phase-in requirements.
    • Used the term “de minimis” to refer to existing minimum chemical reporting levels.
    • Clarified that resubmission of identical annual data (copy and paste) is sufficient, instead of a letter to Ecology confirming no changes from the previous annual report.
    • Updated chemical names to be consistent with terminology in the product testing database.

US - CPSC issued final rule on Phthalates

On 18 October 2017, The U.S. Consumer Product Safety Commission (CPSC) issued a final rule prohibiting children’s toys and child care articles containing more than 0.01% or 1000 ppm of certain phthalate chemicals. The new rule will be effective on 25 April 2018, 180 days from official publication in the Federal Register.

Children’s toys are defined by the CPSIA as products designed or intended by the manufacturer for play by a child of 12 years old or younger. Child care articles are consumer products designed or intended to facilitate sleep or feeding of child age 3 and younger, or to help children with sucking or teething.

There are eight restricted phthalates at concentration of more than 0.1% or 1000ppm by the new rule:

  • diisononyl phthalates (DINP);
  • di-n-pentyl phthalates (DPENP);
  • di-n-hexyl phthalates (DHEXP)
  • dicyclohexyl phthalates (DCHP)
  • diisobutyl phthalates (DIBP)
  • di-(2-ethylhexyl) phthalates (DEHP)
  • dibutyl phthalate (DBP)
  • benzyl butyl phthalate (BBP) 

The new rule also removed the interim prohibition of DNOP and DIDP as CPSC has determined these 2 phthalates do not cause adverse effects or other risks attendant to their use are low.
